UTC Fined Over Chinese Trade Violation
United Technologies Corporation has agreed to pay $13.8 million to the federal government after Pratt and Whitney Canada, a Canadian subsidiary of the Connecticut-based defense contractor, pleaded guilty to violating the federal Arms Export Control Act.
Pratt and Whitney Canada, based outside Montreal, pleaded guilty to illegal exports to China of U.S.-origin military software used in the development of China?s first modern military attack helicopter, the Z-10 and accepted fines of nearly $7 million.
According to the U.S. Department of Justice, Pratt and Whitney Canada delivered 10 of the development engines to China in 2001 and 2002.
The District of Connecticut, the Justice Department filed a three-count criminal information charging UTC, Pratt and Whitney Canada, and HSC with violating the Arms Export Control Act, to making false statements to the U.S. government in their belated disclosures relating to the illegal exports and with failure to timely inform the U.S. government of exports of defense articles to China, according to the U.S. Attorney?s Office.
Pratt and Whitney Canada pleaded guilty to violating the Arms Export Control Act, to making false statements to the U.S. government, but the Justice Department has recommended that prosecution on violating the Arms Export Control Act charges and failure to timely inform the U.S. government of exports of defense articles to Chinabe deferred for two years, provided the companies abide by the terms of a deferred prosecution agreement with the Justice Department.
As part of the agreement, the companies must pay $75 million and retain an Independent Monitor to monitor and assess their compliance with export laws for the next two years.
In addition, UTC, its U.S.-based subsidiary Hamilton Sundstrand Corporation, and PWC have all agreed to pay more than $75 million as part of a global settlement with the Justice Department and State Department.?
Roughly $20.7 million of this sum is to be paid to the Justice Department, according to the U.S. Department of Justice.
The remaining $55 million is payable to the State Department as part of a separate consent agreement to resolve outstanding export issues, including those related to the Z-10.?
Up to $20 million of this penalty can be suspended if applied by UTC to remedial compliance measures.? As part of the settlement, the companies admitted conduct set forth in a stipulated and publicly filed statement of facts.
Speaking in federal court, Paul Beech of UTC, said that since 2006, the time of the violations, "failures addressed today cannot and will not recur."

Team Iowa claimed the team title of the Four State Junior Girls Golf Championship on Thursday at Sedalia (Mo.) Country Club.
The Iowa team entered the second and final round tied with Nebraska, but shot 288 for a total of 588 and a 16-shot victory. Nebraska was second, Missouri was third with 618 and Kansas was fourth.
Former Cedar Rapids Jefferson all-state golfer Megan Furnish shot 76-75-151 over the two days for the third-best Iowa scored and sixth-best in the field of about 20 golfers. Charles City three-time state champion Jessie Sindlinger was first overall, carding 2-under par 68 Thursday for a 5-under 135 total. Sindlinger was the top performer of the tournament and the only golfer to shoot below par.
Dyersville Beckman?s state champion Ellie Ament shot 79-74-153, while South Tama?s Taylor Van Dyk had 78-77-155. Anna Cullinan, of Bettendorf, was 1-over for the second round and finished with 150.
It was the first time since 2004 Iowa has won the event that began in 1969. Sindlinger is the 10th Iowan to earn medalist honors since Patricia Martinson in 1997.

WIMBLEDON, England (AP) ? Novak Djokovic is tough to beat at Wimbledon, indoors or out.
Playing the day's first Centre Court match Friday under the retractable roof, defending champion Djokovic rallied past Radek Stepanek 4-6, 6-2, 6-2, 6-2.
When a drizzle delayed the start of the third round, tournament officials decided Djokovic's match should be played inside. An odd spectacle ensued: The roof closed as the sun came out and outside court covers came off.
"I was a little bit surprised, when I saw sunshine, that the roof is closed," Djokovic said. "Obviously they're relying on a forecast that I don't think is very reliable here. But OK."
The No. 1-ranked Djokovic missed opportunities to seize an early lead, failing to convert his first five break-point chances before he lost serve at love to drop the opening set. But he dominated from there, breaking in the first game in each of the final three sets.
Also advancing to the second week was top-ranked Maria Sharapova. She rallied from a break down in the second set to beat Hsieh Su-wei 6-1, 6-4.
American Sam Querrey hit the last of his 21 aces on match point and beat No. 21-seeded Milos Raonic, 6-7 (3), 7-6 (7), 7-6 (8), 6-4. That second-round match had been suspended in the third set Thursday because of rain.
Kim Clijsters led 6-3, 4-3 when No. 12 Vera Zvonareva retired struggling with a cough. The unseeded Clijsters, who plans to retire after the U.S. Open, is a four-time Grand Slam seeking her first berth in a Wimbledon final.
"It's a pleasure to be a part of the second week of a Grand Slam, especially at Wimbledon," she said.
Americans Sloane Stephens and Christina McHale were eliminated in the third round. The 19-year-old Sloane Stephens was beaten by Sabine Lisicki 7-6 (5), 1-6, 6-2, and the No. 28-seeded McHale lost to No. 8 Angelique Kerber 6-2, 6-3.
No. 3 Agnieszka Radwanska defeated Britain's Heather Watson under the roof, 6-0, 6-2.
Djokovic has the weekend off and said he might squeeze in a round of golf. His fourth-round opponent will be 34th-ranked Viktor Troicki in an all-Serbian match. Troicki beat No. 15-seeded Juan Monaco 7-5, 7-5, 6-3.
Fans were still buzzing about Rafael Nadal's second-round defeat, which ended under the roof Thursday night, when Djokovic stepped onto the same court. His slow start briefly stirred speculation about another upset.
"I was a set down but managed to make the crucial break in the opening game of the second set," Djokovic said. "And then I thought I played really well."
Stepanek, at 33 the oldest man left in the tournament, repeatedly played serve and volley and had Djokovic on his heels in the early going. Djokovic hit an improbable winner that skipped off the top of the net post and still lost the first set.
Then the match quickly swung his way, and the 28th-seeded Stepanek couldn't compete with Djokovic's mistake-free play. The Serb committed just 13 unforced errors in 221 points.
The match remained entertaining even as it became lopsided. One game in the final set lasted 26 points and had Djokovic smiling at Stepanek's unconventional style, which included a belly flop in pursuit of a shot.
"The fourth set from Novak's side was very impressive," Stepanek said. "I was battling until the end, but the fourth set I felt like no matter what I do on the court, he always answers."
The victory made it two in row under the roof for Djokovic.
"I thought I played great," he said. "But, look, this is an outdoor tournament, so I think everybody wants to play when the roof is open."
Perhaps not Sharapova ? she was outdoors struggling with her serve on windy Court 1 and sent one shot over the net on the bounce for a double-fault.
Has she done that before?
"I'm sure I have," she said. "A lot in practice."
The misfire came on break point and put her behind 2-3 in the second set. She rallied by sweeping the final four games.
Sharapova finished with five double-faults but committed only seven unforced errors on her groundstrokes.
"Considering the conditions, I'm pretty happy with the way I played," she said.
Sharapova won the French Open this month to complete a career Grand Slam title. She won Wimbledon at age 17 in 2004 and has reached the final at three of the past four majors.
The half of the men's draw opposite Djokovic opened up when two-time champion Nadal lost to No. 100-ranked Lukas Rosol of the Czech Republic, 6-7 (9), 6-4, 6-4, 2-6, 6-4.
Nadal had reached the past five Grand Slam finals and won his seventh French Open title this month. He also had reached the final in his past five Wimbledons, winning the title in 2008 and 2010.
His departure creates an opportunity for three-time Wimbledon finalist Andy Roddick and Andy Murray, who seeks to become the tournament's first British champion since 1936. Both are on Nadal's side of the draw.

By Pat Mertz EssweinJanuary 26 2009Between the housing slump and the credit crunch mortgage lenders last year were as underworked as the Maytag repairman. But now business has picked up nicely thanks to rates that recently dipped to around 5 on a 30year fixedrate mortgage. If you currently have a loan with a rate higher than say 6 or an adjustablerate mortgage ready to reset this could be the time to refinance.
But just before Thanksgiving the Federal Reserve announced that it would purchase 100 billion of mortgages from Fannie Mae Freddie Mac and the Federal Home Loan Banks and 500 billion of mortgagebacked securities backed by Fannie Freddie and Ginnie Mae. That moved the markets to bid up bond prices which lowered mortgage rates dramatically. In mid December the Fed lowered rates again and announced plans to pump money into the system including buying large quantities of mortgagerelated bonds and longerterm Treasury bonds.

If your ARM is tied to a Treasury index you may want to refinance sooner than later. Gumbinger says that Treasury indexes probably wont go much lower than they already have and will probably begin to rise as 2009 rolls along and the financial markets start to return to normal. On the other hand the LIBOR still has some room to decline so you may want to sit tight through this reset. See link for info on qualifications.

You have multiple options available to you just with the different products on the market currently. You can do fully amortized loans interest only 40 and 50 year amortized products and even option arms with minimum payments and negitive amortization. Where I would start if I was your loan officer would be to see exactly what type of payments you currently have including revolving debt car payments student loans personal loans and so on. With this information I would then determine what you mandatory cash out flow would be monthly for the 2 home loans and other debt.

Not only will I see less money out of pocket per month but there can be tax advantages as well. You mention wanting to add onto the home in 5 or so years. Do you plan on taking funds from the equity in the home at that time If so refinancing into another long term fixed product may not be in your best interest. You may want to look into a 7 year fixed ARM for the lower rate especially if your going to go through all of this again in 5 years. Paying extra for a 30 year fixed which is going to be refied in 5 years does not make sense.

As a mortgage professional I always recommend that my clients refinance out of an ARM after the prepayment penalty period expires if there is one and when the initial low fixed rate period is over. If youre credit is in good shape you may qualify for a similar rate on a 30 year fixed mortgage.

Bob Mansfield, Apple's SVP of Hardware Engineering, is Retiring
Apple today announced that Bob Mansfield, Apple's senior vice president of Hardware Engineering, will retire and the role will be transitioned to Dan Riccio, Apple's vice president of iPad Hardware Engineering, over several months. The entire hardware engineering team will continue to report to Mansfield until his departure.
"Bob has been an instrumental part of our executive team, leading the hardware engineering organization and overseeing the team that has delivered dozens of breakthrough products over the years," said Tim Cook, Apple's CEO. "We are very sad to have him leave and hope he enjoys every day of his retirement."
"Dan has been one of Bob's key lieutenants for a very long time and is very well respected within Apple and by the industry," added Cook. "Our hardware engineering team is the best engineering team on earth and will not miss a beat during the transition."
As senior vice president of Hardware Engineering, Mansfield has led Mac hardware engineering since 2005, iPhone and iPod hardware engineering since 2010, and iPad hardware engineering since its inception. Mansfield joined Apple in 1999 when Apple acquired Raycer Graphics, where he was vice president of Engineering. Mansfield earned a BSEE degree from the University of Texas at Austin in 1982.
Riccio currently serves as vice president of iPad Hardware Engineering and has been instrumental in all of Apple's iPad products since the first generation iPad. Riccio joined Apple in 1998 as vice president of Product Design and has been a key contributor to most of Apple's hardware over his career. Dan earned a bachelor's degree in Mechanical Engineering from the University of Massachusetts Amherst in 1986.

Man dies after being convicted in Ariz. arson case
PHOENIX (AP) ? A man collapsed in court and died after being convicted Thursday of deliberately burning down his $3.5 million Phoenix mansion.
Maricopa County sheriff's deputies said they were investigating whether Michael Marin put something in his mouth that led to his death after the verdict was read.
"We will have to wait until we get toxicology reports from the medical examiner until we can confirm if he did and what the substance was," sheriff's spokesman Jeff Sprong said in a written statement.
A jury had found Marin, 53, guilty of arson of an occupied structure. When his trial began in May, prosecutors said he faced up to nearly 16 years in prison if convicted.
Video from inside the courtroom showed Marin putting his hands over his eyes after the verdict was read and then covering his mouth with both hands.
As Judge Bruce Cohen and lawyers were discussing aggravating factors and the jury was out of the courtroom, Marin's face suddenly turned red and he began to make throat-clearing noises before he collapsed to the floor.
Marin's attorneys tried to assist him, and paramedics were called. Rescuers performed chest compressions but Marin was pronounced dead at a hospital.
Calls to his lawyer, Lindsay Abramson, and to the county medical examiner's office weren't immediately returned Thursday afternoon.
Prosecutors claimed Marin torched his Biltmore Estates mansion, near the Phoenix-Paradise Valley border, in July 2009 after it didn't sell at a charity auction. He had offered the 10,000-square-foot property to raise money for a Mesa-based child-welfare organization.
Prosecutors said Marin couldn't afford the monthly mortgage of $17,500 and had a balloon payment of $2.3 million coming due.
Authorities said Marin escaped the fire by climbing down a rope ladder while wearing a scuba tank and diving mask to protect him from the smoke.
Phoenix Fire Department investigators noted "four separate areas of origin" ? two upstairs and two downstairs ? and a Phoenix crime lab analysis revealed gasoline in two areas of the mansion.
Marin was a former attorney, banker and art collector who had nearly $900,000 in the bank in 2008 but only $50 at the time of the fire, the Arizona Republic reported.

Spray-paintable batteries even might become available to the general public someday at hardware stores, the scientists added.
Lithium-ion batteries power most portable electronics nowadays, but their spiral, jelly-roll-like design generally limits them to rectangular or cylindrical shapes.

Now researchers have succeeded in painting these batteries onto a diverse range of surfaces, including glass slides, stainless steel, flexible plastic sheets, glazed ceramic tiles, and even the curved side of a beer mug.
"We can convert almost any object to a battery," Neelam Singh, a materials scientist at Rice University in Houston, told InnovationNewsDaily.
He and other researchers spent painstaking hours formulating paints that could function as the separate components of a battery. In their search, they looked at materials as diverse as carbon nanotubes and ultrafine graphite powders. They next painted these ingredients in layers in the proper order onto surfaces to create the batteries.
"Spray painting is already an industrial process, so it would be very easy to incorporate this into industry," Singh said.
Batteries that the researchers printed onto nine ceramic bathroom tiles could readily power 40 red LED lights. One of these battery tiles was topped with a solar power cell that helped charge the batteries, suggesting the researchers could give any surface the capability to both harvest and store energy.
The material onto which the batteries were painted apparently had no effect on the performance of the devices. This suggests this technology could find its way into a wide range of construction materials and household objects.
"You could turn your home into a battery," Singh said.
The researchers do caution that fabricating these batteries requires the use of toxic, flammable and potentially corrosive materials in an oxygen-free and moisture-free environment. Employing safer battery materials along with oxygen- and moisture-resistant paints could allow even the general public to spray-paint batteries.

"People paint their homes and cars often," Singh said. "I think it will be possible for people to paint batteries themselves."
The scientists have filed for a patent on their work. They detailed their findings online June 28 in the journal Scientific Reports.

Palestinian: US supports 'an apartheid system'
BETHLEHEM, WEST BANK ? At the Aida Refugee Camp, a few blocks from Israel?s separation wall, is the Al Rowwad Cultural and Theater Center founded by Dr. Abdelfattah Abusrour in 1998 with the philosophy of ?beautiful resistance? against the Israeli power over their land.
Abusrour is part of the first generation of children born to refugee parents in the Aida Refugee Camp, which was established in 1950 between the towns of Bethlehem and Beit Jala. It is now home to around 5,000 inhabitants all descendants from the 1948 expulsion from Palestine.
Abusrour considers himself ?fortunate? to have gotten a scholarship to study in France, where he stayed for nine years and got his master?s and Ph.D in biological and medical engineering. But his heart was always also with theater, painting and photography. He came home with the dream of working with children to help shape the future of a Palestinian state.
The center started working with children in refugee camps in the area of Bethlehem and Bet-Jala, but then spread all over the West Bank with mobile ?beautiful resistance? programs in theater, dance and music training.
He explained the center?s philosophy: ?Resistance, because we are under occupation still until today and we have this right to resist the occupation; and beautiful, to reflect all this beauty, this humanity, this culture, this heritage, this beautiful heritage of unarmed struggle that the Palestinians have carried over the years even before Gandhi and Martin Luther King.?

U.S. is ?supportive of an apartheid system that is suffocating us?
The center takes some of the children to tour and perform internationally.
?We go internationally to give the children the possibility to see real, free and peaceful countries without checkpoints, without tear gas, without occupation soldiers,? said Abusrour.
Children have toured in the United States, among many other countries.?
Abusrour says he was very eager to tour with the children in the U.S. because it is the richest, most powerful democracy in the world. But he also wanted to show them that even in the biggest democracy, injustice can be found.?

?We took our children to poor areas like Afro-American neighborhoods because it was important for me to show them as Palestinians that there are equal injustices in other places of the world,? he said.
While he appreciates the power of the U.S., Abusrour believes that as a country, it is not living up to its ideals. ?
?The United States of America is a country like any other country. It has its beauty and faults," said Abusrour. He added that it is "the land of free and the brave, apparently, and they are violating the values that they pretend defending.?
For many Palestinians, it is hard to ignore the long-term support the U.S. has given and continues to give Israel for its security. ?Many find it hard to understand how a country like the U.S., which plays a leading role in shaping the policies of other countries, can help Israel?s continuous violation of the Palestinian?s rights.
?As a Palestinian I see that [the U.S.] is supportive of an apartheid system that is suffocating us, that is continuing a violation of human rights and human values that we share as Palestinians,? said Abusrour. ?I see the governments of the United States of America, one after the other, supporting this illegal occupation.??

Fabregas delivers again with penalty for Spain

DONETSK, Ukraine (AP) -Four years after delivering the penalty credited with starting Spain's era of dominance, Cesc Fabregas has ensured the country's golden run lives on.
Fabregas scored the decisive spot kick against Portugal on Wednesday to send Spain back to the European Championship final. Spain will play either Germany or Italy in Sunday's final in Kiev, where it can become the first team to win three straight major championships.
"I had this intuition that we could advance if we went to penalties and that's what we did," Fabregas said. "I was going up to take the fifth penalty and I already felt that I would do it. There's a lot of emotions (when stepping up to take a penalty)."
At Euro 2008, it was also Fabregas who converted the winning penalty in a shootout victory over Italy in the quarterfinals, which Spain's players have said put the team on course for trophy success.
Fabregas' penalty against Italy four years ago secured Spain's passage into the semifinals, where it beat Russia before a 1-0 win over Germany in the final for its first title in 44 years. In the 2010 World Cup final, Fabregas delivered the pass for Andres Iniesta to score the extra-time winner to beat the Netherlands and win the tournament in South Africa.
Spain's players have often credited Fabregas' penalty as lifting the fog of underachievement at major tournaments, where it always arrived with talent but never lived up to expectations.
Now, Spain has a chance to become the first team to win three straight major titles.
"I played poorly, but the team worked really hard," said Fabregas, who replaced striker Alvaro Negredo in the 54th minute. "Being in another final is a miracle. It's really incredible."
Coach Vicente del Bosque said Fabregas indicated he wanted to take the decisive spot kick.
"All five of them offered to shoot the penalties," Del Bosque said. "Cesc told me 'I want to do the fifth one, to be the victorious one."'
Left back Jordi Alba gave Fabregas some inspiration before the Barcelona forward stepped up to the penalty spot.
"When Cesc was going to take the fifth penalty, I told him, 'Look, you have another opportunity to do the same thing as in the previous Euro,"' Alba said.
Fabregas, who has scored two goals in the tournament, hoped his deciding shot delivered some joy to Spanish supporters, who numbered a few thousand in the Donbass Arena.
"I hope they will all go to party," said Fabregas, whose penalty just came off the inside the left post and stayed in.
